Terms and Conditions Mountain Card 2025

 

1. Contractual Conditions for the Use of the Mountain Card
These general terms and conditions contain the terms for the purchase and use of the Mountain Card. The Mountain Card is available in different ticket variants: 10 day tickets in summer, 3 day tickets in 4 days, 5 day tickets in 7 days. The Mountain Card is a ticket for passenger transport that allows the use of the lifts of the companies participating in the Mountain Card initiative. The list of participating companies is published and regularly updated on the website mountaincard.it.

2. Contracting Parties
The participating companies are solely responsible for the operation and management of the facilities and the transport service. The Mobilitätskonsortium does not operate lifts, recreational facilities, trails, routes, or bike parks and therefore has no maintenance obligations or liability. Any claims must be made to the participating companies or the responsible trail/route manager.

3. The Ticket
The ticket is personal and can only be used by the rightful holder. It cannot be transferred to third parties, even free of charge, nor exchanged, manipulated, or modified after purchase, even if purchased online. The ticket entitles the rightful holder to use the facilities of the participating companies for the entire validity period of the ticket, depending on the type of card purchased. The ticket contains the personal data of the holder (first name, last name), the type of card purchased, and the corresponding age (A=Adult; J=Junior; born after 01.01.2007; K=Child, born after 01.01.2017).

4. Validity Period of the Tickets and Periodic Update of the Operating Facilities

The season in which the Mountain Card tickets are valid at the participating and open lifts begins on 17.05.2025 and ends on 09.11.2025. Detailed information on the opening hours of the lifts is available on the official websites of the participating companies. Users acknowledge that the decision to open the lifts is made daily and at the discretion of the participating companies, based on the current energy market situation and the unpredictable development of energy supply costs. Users accept the risk of limitations on the usable facilities and possible daily changes in the operating facilities, and waive any form of refund, compensation, or indemnity in case of limitations or total closure of the facilities.

5. Subject of the Contract
The subject of the contract is exclusively the transport of persons from the valley station to the mountain station of the respective facility and/or vice versa. All types of tickets are valid only for the transport of persons. For the transport of bicycles, strollers, suitcases, animals, paragliders, and other items and accessories, the conditions provided by the operators of the individual lifts apply. The user is required to obtain information at the ticket offices of the respective lift. On lifts marked only with the symbol "Lift for hikers," the transport of bicycles is not allowed. Any other activity outside of transport (trekking, mountain biking, even within the "Bike Parks" or similar facilities) is at the user's own risk and peril.

6. Determination of the Subject of the Contract in Relation to the Operation of the Lifts
The continuous operation and operation during the entire indicated operating period of the participating lifts are not guaranteed, as they depend on factors beyond the control of the operators, such as weather and safety conditions, equipment failures, availability of energy sources and related procurement costs, epidemics and/or pandemics, orders from authorities, and other force majeure and unforeseeable circumstances. In all these cases, any form of refund or compensation is excluded, and, in derogation of Articles 1463 and 1464 of the Italian Civil Code, any form of compensation is expressly excluded if the subsequent impossibility or excessive burden of performance or use is due to a cause not attributable to the Mobilitätskonsortium or the participating companies.

7. Purchase – Prices, Discounts, and Reductions
The tickets are valid exclusively in the summer season in which they are issued. The purchase of the tickets is not subject to the right of withdrawal provided by the consumer protection law (Art. 47 and 59 of Legislative Decree 206/2005). The prices and discounted rates are indicated together with the requirements and necessary documents for their granting (which cannot be replaced by self-declarations) on the website mountaincard.it. The Mountain Card for children (born after 01.01.2017) is free if a ticket of the same type and for the same period is purchased simultaneously by an accompanying adult, with whom the child's card is linked. The Mobilitätskonsortium does not guarantee the uninterrupted operation of the online shop. Even if the Mountain Card is purchased before the start of the validity period, the purchase price will not be refunded under any circumstances, not even in case of non-use or partial use, cancellation of holidays, unforeseen commitments, illness, etc.

8. Principle of Non-Replaceability and Non-Refundability of Tickets
The purchased tickets are neither replaceable nor refundable. Tickets that are not used or only partially used, lost, stolen, canceled, suspended, or intentionally damaged will not be replaced or refunded. Issued tickets that can only be partially used during their validity days cannot be used in subsequent seasons.

9. Liability in Connection with the Use of the Facilities and Minors Under 18 Years of Age
Each user must comply with all applicable regulations and legal provisions of state, regional, and provincial legislation, as well as the general rules of conduct and passenger regulations posted at the entrance of each lift. Neither the Mobilitätskonsortium nor the operator of the respective lift used is liable for damages resulting from improper use of the lifts or recreational facilities, as well as for the consequences of unlawful acts by users during their stay on the lifts. By using the lift by a minor, the accompanying adult declares, with the purchase of the Mountain Card, to know the civil liability regarding the supervision of minors, even during the use of the facilities. The transport of a minor takes place under the supervision, responsibility, and control of the accompanying adult, excluding any liability of the lift operator. The responsibility of the parents or legal representative of the minors is presumed in case of use of the lifts by the latter.

10. Obligation to Cooperate with Service Personnel and Consequences in Case of Violations
Users must show their Mountain Card upon request by service personnel or inspectors and allow the identification of their person by presenting a valid identity document. Any misuse of the aforementioned tickets (e.g., use by another person instead of the holder of a non-transferable card) immediately results in the withdrawal and cancellation of the ticket in question. Tickets can also be withdrawn, canceled, or their validity suspended in case of violation of the existing regulations of state, regional, or provincial legislation by the competent supervisory authority. Flying with paragliders, hang gliders, drones, etc. near the lines of the lifts is strictly prohibited by law. In case of violation of the existing regulations, administrative penalties and the withdrawal of the permit to use the facilities of the participating companies are foreseen. In case of misuse of tickets for children (K) born after 01/01/2017, both the free card and the adult card linked to the purchase will be blocked and/or canceled. Any abuse will be prosecuted legally: the legal recourse, including any necessary actions to establish criminal (e.g., fraud under Art. 640 of the Italian Penal Code) or civil liability of the offender, remains reserved.

11. Final Provisions
The buyer is responsible for the careful custody of the ticket. As a transport document, the Mountain Card, necessary and irreplaceable for access to the participating lift facilities and for the transport of the holder, as described in Art. 1, meets the requirements of a tax document and must therefore be kept for the entire duration of the transport. By purchasing or using a Mountain Card, the user declares to know and fully accept these general terms and conditions; the same can be consulted on the website mountaincard.it. In case of doubts and discrepancies between the different language versions, the German version of these general terms and conditions prevails.

12. Applicable Law and Jurisdiction
In case of disputes regarding the validity or execution of the transport contract or these general terms and conditions of sale, Italian law applies, with exclusive jurisdiction of the courts of Bolzano, unless the conditions for consumer jurisdiction are met.
